Gift funds from India: documents to line up

Blog posts have promised this list. Here it is, on the page, with no gate. It is a starting point for U.S. mortgages in Texas, California, Georgia, and Florida. It is not a tax opinion and not a promise that every lender accepts gifts.

Bring these

Gift letter signed by the donor: the amount, that it is a gift and not a loan, the donor's name, and the borrower's name.

Evidence of the donor's ability to give: a bank or NRE/NRO statement the lender accepts. The lender decides how many days it needs to see.

The wire receipt and the incoming credit in the borrower's account, with names that match the letter.

If the money moved through more than one account, the statements that connect those hops.

A note on IRS Form 3520. The IRS instructions describe reporting for certain large foreign gifts. Whether your transfer is reportable is a tax question. We are not your tax advisor.

Do not wire until the lender has said this gift structure is acceptable on your file.

What we will not do on this page

We will not email a PDF we cannot actually generate, and we will not text the list to WhatsApp automatically. The list is above. If you want to walk through your wire, message us on WhatsApp or start the form.

We originate only in Texas, California, Georgia, and Florida.

Questions

Is every transfer from India a gift?

No. A loan from family is not a gift, and calling it a gift on a letter does not make it one. Tell the lender what the money actually is.

Does Form 3520 mean the mortgage is denied?

No. Form 3520 is an IRS reporting form. It is separate from the lender's sourcing of the deposit. Read the IRS instructions or ask a tax advisor.
