Quick answer (updated October 2026): Yes, H-4 EAD income can count toward a mortgage. Fannie Mae treats it like any other wage income: a two-year history is recommended, and at least 12 months can work with offsetting factors. The biggest 2026 risk is timing, because automatic EAD extensions ended, so an expired card with a pending renewal may stop the income from counting.

For many H-1B families, the H-4 EAD is the difference between a starter townhome and the house near the good school.

But H-4 EAD income comes with quirks underwriters notice: career breaks before the EAD arrived, short job tenure, and an EAD renewal cycle that got riskier in 2026. This guide covers how lenders count H-4 spouse income, the history rules, the renewal trap and a worked comparison of single vs dual income.

Who has an H-4 EAD, and why lenders care

An H-4 spouse can get work authorization when the H-1B spouse has an approved I-140 or has extended H-1B status under AC21 beyond the six-year limit. That eligibility hasn't changed as of October 2026.

For the lender, the H-4 EAD spouse is a non-permanent resident borrower. Under Fannie Mae B2-2-02, non-permanent residents are eligible on the same terms as US citizens, and Freddie Mac's guide takes the same approach. There's no rule that an H-4 spouse's income is "secondary" or discounted. If the income is stable and documented, it counts dollar for dollar.

FHA is not an option for either spouse; HUD Mortgagee Letter 2025-09 ended FHA eligibility for non-permanent residents.

An approved I-140 behind the H-1B, which is what made the H-4 EAD possible, also helps the overall file. Our post on how an approved I-140 strengthens your mortgage file explains why.

H-4 EAD job history: the two-year pattern

Fannie Mae's B3-3.2-02 (03/04/2026) asks lenders to confirm "a reliable pattern of employment over the most recent two years." A two-year history for each income source is recommended. Income received for at least 12 months can be acceptable with positive offsetting factors.

That rule creates the most common H-4 problem: the career break. Many H-4 spouses spent years unable to work before the EAD arrived. Here's how underwriters typically view it:

  • Back to work, same field, 12+ months: Usually fine. Prior experience in India or the US in the same line of work is an offsetting factor.

  • Back to work under 12 months: Often not counted, or counted only with strong offsets. Ask before you assume.

  • Gaps between jobs: For borrowers with multiple employers, Fannie says no gap greater than one month in the last 12 months unless the work is seasonal.

  • Part-time or variable hours: Usually averaged over the history; a short history makes averaging harder.

Document the break. A one-paragraph letter saying "I was on H-4 without work authorization from 2019 to 2024" turns a red flag into a known reason.

How H-4 spouse income counts: scenario table

H-4 EAD situation How it's usually treated What to bring
Salaried W-2, 2+ years, same employer Full base salary counts 30 days paystubs, 2 years W-2s
Salaried W-2, 14 months after a career break Often counts with offsets (same field, prior experience) Paystubs, W-2, resume or letter on prior work
W-2, 6 months on the job Often not counted; some lenders allow with strong offsets Paystubs, offer letter, education/experience
Self-employed or 1099 on H-4 EAD Needs self-employment history, usually tax returns Returns, 1099s, business documentation
EAD expired, renewal pending (filed after Oct 30, 2025) Income may not count; work authorization gap Receipt notice, employer status letter
Bonus or overtime Needs a history before it counts YTD paystub, prior year W-2

Self-employed H-4 EAD holders (consulting, tutoring, a home bakery) face Fannie's self-employment standard: generally a two-year history, or 12 months from the current business on recent tax returns with prior same-field earnings.

The 2026 EAD renewal trap for an H4 EAD income mortgage

This is the change that matters most for an h4 ead income mortgage this year.

DHS ended the 540-day automatic extension of EADs for renewals filed on or after Oct 30, 2025, and finalized that change effective Oct 14, 2026. H-4 EADs are affected. If the H-4 spouse's card expires while the renewal is pending, the spouse can no longer legally work until the new card arrives.

For your loan:

  1. Before application: Check the EAD expiration date. If it expires within the next 6 months, plan around it.

  2. During processing: Lenders re-verify employment shortly before closing. If the card expired and work stopped, that income disappears from the file.

  3. Closing date: Aim to close while the H-4 EAD is unexpired. If you can't, qualify on the H-1B income alone or wait for the new card.

Our full breakdown is in EAD renewal pending: why the end of automatic extensions changes your closing date.

Dual income H-1B/H-4 mortgage: worked example

Say Vikram (H-1B, hypothetical) earns $140,000 and Ananya (H-4 EAD, hypothetical) earns $66,000 after 18 months at a hospital lab in Plano. They have a $700 car payment. For illustration, assume a 45% total debt-to-income limit and $1,400/month for taxes, insurance and PMI. Actual limits depend on the underwriting findings and lender.

H-1B only H-1B + H-4 EAD
Gross monthly income $11,666.67 $17,166.67
Max total debt at 45% $5,250 $7,725
Minus car payment $4,550 $7,025
Minus taxes/insurance/PMI $3,150 $5,625
Approx. max loan at 7.40% (30-yr) ~$455,000 ~$812,000

Rate: Freddie Mac weekly average, Oct 15, 2026 — illustration only, not a quote or offer.

The H-4 income nearly doubles their loan capacity. That's why the EAD renewal date matters so much. If they couldn't count Ananya's income, they'd need to shop in a very different price range. If they're in that position, our guide to a single-income mortgage with an H-4 spouse shows how to make one paycheck work.

Note: capacity isn't a target. Many families choose a lower payment so the H-1B income alone could carry the home if the H-4 EAD ever lapses.

Lender overlays to watch

Fannie Mae has no H-4 rule, but lenders sometimes add one:

  • Requiring the H-4 EAD to have 12+ months remaining.

  • Excluding H-4 income if the H-1B spouse's I-797 expires soon.

  • Requiring both spouses on the loan to have a minimum score.

These are overlays, not agency rules. Our post on mortgage lender overlays for visa holders shows how to identify them.

What the rules actually say

  • Fannie Mae Selling Guide B3-3.2-02 (03/04/2026): Two-year history recommended; income received for at least 12 months may be acceptable with offsetting factors; no gap over one month in the last 12 months for borrowers with multiple employers, unless seasonal.

  • Fannie Mae B2-2-02 (07/28/2015): Non-permanent residents eligible on the same terms as citizens.

  • DHS EAD rule (interim Oct 30, 2025; final effective Oct 14, 2026): Ended the 540-day automatic extension for most renewals filed on or after Oct 30, 2025, including H-4 EADs.

  • HUD Mortgagee Letter 2025-09: H-1B and H-4 holders are not eligible for FHA (case numbers on/after May 25, 2025).

Frequently Asked Questions

Q: Can H-4 EAD income be used to qualify for a mortgage?
A: Yes. Fannie Mae counts H-4 EAD wages like any other income when the history is stable and documented. A two-year history is recommended, and 12 months or more can work with offsetting factors such as prior experience in the same field. The H-4 spouse should also have an unexpired EAD at closing.

Q: How long does my H-4 spouse need to be working before the income counts?
A: Generally 12 months is the practical minimum, with two years preferred. Some lenders consider shorter histories if the job is in the same field as prior work in India or the US. A short letter explaining the career break before the EAD arrived helps the underwriter understand the gap.

Q: What happens if my H-4 EAD expires before closing?
A: For renewals filed on or after Oct 30, 2025, there's no automatic extension. If the card expires, the spouse must stop working, and the lender can't count that income. Plan to close while the EAD is valid, or qualify on the H-1B income alone. Talk to your immigration attorney about renewal timing.

Q: Does the H-4 spouse have to be on the loan?
A: No. You can apply with the H-1B spouse alone, and the H-4 spouse can still be on title in most cases. You only add the H-4 spouse as a borrower if you need their income to qualify. In community property states like Texas, the non-borrowing spouse may still need to sign certain documents.

Q: Can an H-4 EAD holder get a mortgage alone?
A: Yes, if their income, credit and assets qualify. An H-4 EAD holder is a non-permanent resident, eligible for conventional financing on the same terms as citizens under Fannie Mae's rules. Lenders may add overlays about the EAD's remaining validity and the H-1B spouse's status, so compare lenders.
