**Quick answer (updated October 2026):** The mortgage preapproval documents a visa holder needs are the standard income, asset and credit documents every borrower provides, plus proof of lawful presence: passport, your current approval notice or card (I-797, EAD or green card) and SSN. Fannie Mae lets the lender choose the documentation, so requirements vary. Upload everything once, at the start.

The most common reason visa-holder pre-approvals drag isn't credit or income. It's the back-and-forth: an I-797 sent without the I-94, a green card with the back missing, paystubs from the wrong month. Each round trip costs a few days, and in a competitive market a few days can cost a house.

This is the checklist we use, organized by status, so you can gather everything in one go. Print it, check boxes, and upload once.

## Mortgage preapproval documents every visa holder needs

Start with the core file. These apply whether you're on an H-1B, L-1, O-1, EAD, OPT or a green card.

| **Category** | **Document** | **Notes** |
| --- | --- | --- |
| Identity | Unexpired passport (photo page) | Name should match your SSN record |
| SSN | Social Security number | Fannie Mae requires a valid SSN that can be validated with the SSA |
| Income | Paystubs covering the most recent 30 days | Showing year-to-date earnings |
| Income | W-2s for the last 2 years | All employers |
| Income | Federal tax returns, 2 years (if requested) | Required for self-employed, rental, RSU, foreign income and some other cases |
| Income | Offer letter (if new job or starting soon) | Must be non-contingent if it's your qualifying income |
| Assets | Last 2 months of statements for every account used | All pages, even blank ones |
| Assets | Retirement and brokerage statements | For reserves or down payment |
| Assets | Gift letter and donor's bank statement (if a gift) | Plus proof of transfer |
| Housing | Current lease and landlord contact | Rent history may help your file |
| Credit | Letter of explanation for recent inquiries or late payments | Only if asked |

Watch the name on every document. Mismatches between passport, SSA record and W-2s are the hidden delay; see [name mismatch fixes before closing](https://www.masalaloans.com/blog/name-mismatch-mortgage).

## H1B preapproval documents and other visa-specific items

Here's what lenders commonly request for lawful-presence documentation, by status. Under Fannie Mae B2-2-02, the lender decides what to collect, so one lender may want more than another.

| **Status** | **Commonly requested** | **Worth having ready** |
| --- | --- | --- |
| **H-1B** | Passport, current I-797 approval notice, I-94 | Visa stamp (even if expired); extension receipt if pending; employment verification letter |
| **L-1** | Passport, I-797 (or blanket L approval), I-94 | Visa stamp; employer letter on continued assignment |
| **O-1** | Passport, I-797, I-94 | Contracts or agent agreements if income is variable |
| **TN** | Passport, I-94 showing TN status | Employer letter; prior TN approvals |
| **H-4 or other EAD holder** | Passport, EAD card (front and back), I-94 | Spouse's I-797; EAD renewal receipt if pending |
| **F-1 OPT / STEM OPT** | Passport, EAD card, I-20 with OPT endorsement | H-1B petition receipt or approval if cap-gap applies |
| **Green card (10-year)** | Front and back of green card | I-90 receipt if card expired |
| **Conditional green card** | Front and back of 2-year card | I-751 receipt notice if card expired or near expiry |
| **I-485 pending** | I-485 receipt; current EAD or underlying visa documents | Approved I-140 notice |

A few notes that save weeks:

- **Expired visa stamp, valid I-797 and I-94:** this is common and usually fine, because the stamp is for travel. Lenders who don't understand that are applying an overlay.

- **Remaining validity:** Fannie Mae doesn't set a minimum remaining time on your visa. Lenders that demand one are applying their own rule. See [the visa expiration myth](https://www.masalaloans.com/blog/visa-expiration-mortgage-requirement-myth).

- **Card extensions by receipt:** an I-751 receipt extends a conditional card for 48 months, and an I-90 receipt extends an expired 10-year card for 36 months, as of October 2026. Our guide to [conditional green card mortgages](https://www.masalaloans.com/blog/conditional-green-card-mortgage) covers the details.

## EAD holders: the 2026 timing trap

If your work authorization depends on an EAD, check the expiration date before you go under contract. The automatic extension of up to 540 days for many EAD renewals ended for renewals filed on or after October 30, 2025, and that rule was finalized effective October 14, 2026. An EAD that expires while your renewal is pending can now mean a gap in work authorization, and lenders will treat that seriously at closing.

Our guide to [EAD renewal pending and your closing date](https://www.masalaloans.com/blog/ead-renewal-pending-mortgage-2026) explains how to plan around it. For anything about your immigration case itself, talk to your immigration attorney.

## Green card mortgage checklist: extra items that come up

Green card holders have the most loan options, including FHA. (FHA is not available to H-1B, L-1, O-1, TN, OPT or EAD-only holders after HUD Mortgagee Letter 2025-09.) Items that often come up:

- **Both sides of the card.** Lenders want the back too.

- **Recent arrival with a short job history.** Fannie Mae looks for a reliable two-year pattern but allows a shorter history with offsetting factors. Bring your offer letters, prior employment letters and education documents.

- **Foreign income.** If any qualifying income is paid in a foreign currency, Fannie Mae wants your two most recent years of signed US federal returns showing it.

## What documents for a mortgage immigrant: money from abroad

If any down payment money is coming from India, Pakistan or elsewhere, add these:

| **Situation** | **Documents** |
| --- | --- |
| Your own savings abroad | Foreign account statements (translated if not in English), proof of transfer, US account statement showing receipt |
| Gift from parents abroad | Gift letter, donor's statement showing the funds, transfer record, your US statement showing receipt |
| Proceeds from selling property abroad | Sale deed, bank credit of proceeds, transfer and receipt records |

Fannie Mae requires foreign funds to be exchanged into US dollars and held in a US or state-regulated institution before closing, with translations. Move the money early so it's documented by the time you're under contract.

## How to upload once and get a faster pre-approval

1. **Scan in color, all pages.** Including blank pages of bank statements.

2. **Name files clearly.** "Passport\_Priya.pdf," "I797\_2026.pdf," "Chase\_Aug\_Sep.pdf."

3. **Combine by category.** One PDF for immigration documents, one for income, one for assets.

4. **Add a one-page cover note.** Your status, any pending filings, expected gift amounts, and every version of your name.

5. **Send it all at once.** Partial uploads cause the most delay.

## What the rules actually say

- **Fannie Mae B2-2-02 (07/28/2015):** non-permanent residents eligible on the same terms as citizens; the lender determines documentation of lawful presence; no visa list or minimum remaining validity. Freddie Mac's guide takes the same approach.

- **Fannie Mae B2-2-01 (09/03/2025):** each borrower must have a valid SSN that can be validated with the SSA.

- **HUD Mortgagee Letter 2025-09:** non-permanent residents ineligible for FHA for case numbers on or after May 25, 2025; green card holders remain eligible.

- **USCIS EAD rule:** automatic extensions ended for renewals filed on or after Oct 30, 2025; finalized effective Oct 14, 2026. I-751 receipts extend conditional cards 48 months; I-90 receipts extend expired 10-year cards 36 months.

## Frequently Asked Questions

**Q: What documents do I need for a mortgage pre-approval on an H-1B?**
A: Typically your passport, current I-797 approval notice, I-94, SSN, 30 days of paystubs, two years of W-2s and two months of bank statements. Some lenders also want your visa stamp or an employer letter. Fannie Mae lets lenders set lawful-presence documentation, so requirements vary.

**Q: Do I need my visa stamp to get pre-approved?**
A: Not always. The stamp is a travel document. Many lenders accept a valid I-797 and I-94 even if the stamp has expired, because those show current status. A lender that insists on a valid stamp is applying its own overlay, and other lenders may not.

**Q: Can I get pre-approved with a pending H-1B extension?**
A: Often, yes, with the receipt notice and your current I-797. Lender treatment varies, so a broker can match you with lenders that accept pending extensions. If the extension involves a job change, have your new offer letter and paystubs ready too.

**Q: What if my green card is expired?**
A: If you've filed an I-90, the receipt extends your card's validity for 36 months as of October 2026. For a conditional card, an I-751 receipt extends it for 48 months. Provide the card and the receipt notice together.

**Q: How long does a mortgage pre-approval take for visa holders?**
A: With a complete file, often a day or two. Delays usually come from missing pages, unexplained deposits or immigration documents that don't match. Sending everything in one organized upload is the biggest thing you can do to speed it up.
