**Quick answer (updated October 2026):** If your new construction visa expire date falls before completion, what matters is your status and documents at closing, not at contract. Fannie Mae sets no minimum remaining validity, but many lenders want a valid I-797 or EAD, or a timely extension receipt, when the loan funds. Plan the extension, lock strategy and contract terms around the expected closing month.

Builders in Texas, Georgia and North Carolina are quoting 8 to 14 months for a to-be-built home. Your H-1B approval notice ends in 9. Your spouse's H-4 EAD ends in 7. The sales rep says "don't worry, our lender handles visa buyers all the time." You'd like something more concrete than that before writing a big earnest money check.

This guide explains how lenders actually look at status on a long build, how to line up your visa renewal during the build, the rate lock options, and the contract protections worth asking for.

## Why the closing date is what counts when you build a home on an H-1B

A pre-approval at contract signing is just a snapshot. On a new build, the lender will re-verify nearly everything near closing: income, employment, assets, credit and immigration documents. Underwriting documents have shelf lives, so the file you were approved on in February gets refreshed in November.

That cuts both ways:

- **Good news:** A visa that expires before closing isn't a problem at contract, as long as you'll have valid documents, or an acceptable pending extension, at closing.

- **Risk:** If something changes during the build, such as a job change, layoff, denied extension or EAD gap, the loan is decided on the new facts.

At the agency level, Fannie Mae's Selling Guide (B2-2-02) lets non-permanent residents borrow on the same terms as citizens and requires the lender to confirm lawful presence. It has no visa list and no minimum validity. Our guide to the [visa expiration mortgage requirement myth](https://www.masalaloans.com/blog/visa-expiration-mortgage-requirement-myth) covers that in detail. Lender overlays are where the expiration date starts to matter.

### What lenders commonly want at closing

| **Your situation at closing** | **Agency view** | **Common lender overlay** |
| --- | --- | --- |
| Valid I-797, any time remaining | Eligible | Some want 6–12+ months left |
| I-797 expired, extension filed, receipt notice in hand | Lender decides documentation | Many accept the receipt; some don't |
| Extension approved, new I-797 issued | Eligible | Generally fine |
| Expired visa stamp, valid I-797 | Eligible | Generally fine; stamp is for travel |
| EAD expired, renewal pending | Lender decides; work authorization gap is a real issue | Often a hard stop |
| Approved I-140 on file | Not required | Helps show likely continuance |

## Visa renewal during the build: plan backward from closing

Work backward from the builder's estimated completion date, then add a cushion. Builders run late.

| **Timeline (illustration)** | **Construction** | **Mortgage** | **Visa/status** |
| --- | --- | --- | --- |
| Month 0 | Contract, earnest money | Pre-approval, ask lender about visa overlays in writing | Note every expiration date (yours and spouse's) |
| Months 1–3 | Permits, foundation | Decide lock strategy | Talk to employer and immigration attorney about extension timing |
| Months 4–8 | Framing, mechanicals | Avoid new debt, keep job stable | Extension filed when your attorney advises |
| Months 8–10 | Finishes | Updated pay stubs, statements, credit | Receipt notice or new approval in hand |
| Closing month | Final walkthrough | Final underwriting, status check | Lender reviews whatever you hold that day |

The details of when and how an extension can be filed are an immigration question. Talk to your immigration attorney and your employer's HR team early, and tell them you're closing on a home in a specific month.

If you'll be closing on just a receipt notice, read [getting a mortgage with an H-1B extension pending](https://www.masalaloans.com/blog/h1b-extension-pending-mortgage) so you know what lenders ask for.

### The EAD trap in 2026

The automatic 540-day extension for many EAD renewals is gone. The interim rule of Oct 30, 2025 ended it for renewals filed on or after that date, and the final rule took effect Oct 14, 2026. If your income, or your spouse's H-4 EAD income, is part of qualifying, an EAD that expires while the renewal is pending can mean a work authorization gap right at closing. See [EAD renewal pending and your closing date](https://www.masalaloans.com/blog/ead-renewal-pending-mortgage-2026).

If you can qualify on one income alone, ask the lender to underwrite that way from the start.

## Extended rate lock on new construction: your options

On a long build, you can't lock a normal 30- or 45-day rate at contract signing. Choices, as of October 2026:

1. **Float until closer to completion.** No upfront cost, full rate risk. Rates moved from 6.95% to 7.40% between mid-September and mid-October 2026 on the Freddie Mac weekly average (illustration only, not a quote or offer). That shows how fast things change.

2. **Extended lock.** Some lenders offer locks of 90 days to a year or more. They usually cost more, through a higher rate, upfront fee or both. Some include a one-time float-down.

3. **Builder's forward commitment.** Builder-affiliated lenders sometimes offer long locks or bought-down rates as an incentive, usually only with their lender. Compare the full cost in [builder's preferred lender vs. your own broker](https://www.masalaloans.com/blog/builder-preferred-lender-vs-broker).

Ask any lender what happens if the build runs past the lock expiration, and who pays the extension.

| **Lock strategy** | **Cost** | **Rate risk** | **Best for** |
| --- | --- | --- | --- |
| Float, lock at ~60 days out | Lowest | Highest | Flexible budget, DTI cushion |
| Extended lock at contract | Higher | Low | Tight DTI, no room for a higher payment |
| Extended lock with float-down | Highest | Low, with upside | Uncertain rate environment |
| Builder forward commitment | Built into incentive | Low | When builder's lender accepts your visa |

## Contract protections for visa holders building a home

Builder contracts are written by the builder. Many limit or exclude a financing contingency, and earnest money on new construction can be large. Before you sign:

- **Read the financing section.** Is there any financing contingency? What happens if your loan is denied due to a change in immigration status?

- **Check earnest money and upgrade deposits.** Design-center upgrades are often non-refundable.

- **Ask about assignment or cancellation terms.** Some builders allow cancellation with partial refund. Get it in writing.

- **Consider a real estate attorney review.** Especially for large deposits.

### Reduce the chance you'll need those protections

- **Keep your job stable during the build.** A job change on an H-1B is possible, but it adds paperwork at the worst time.

- **Hold extra reserves.** Six months or more of PITIA gives underwriters comfort.

- **Get your I-140 approved if you're in process.** It doesn't change agency eligibility, but it supports continuance. See [how an approved I-140 strengthens your mortgage file](https://www.masalaloans.com/blog/approved-i140-mortgage-advantage).

- **Pick a lender panel, not a lender.** If one lender's overlay changes mid-build, you need somewhere else to go.

## What the rules actually say

- **Fannie Mae Selling Guide B2-2-02 (07/28/2015):** Non-permanent residents eligible on the same terms as citizens; lender determines documentation and confirms lawful presence. No minimum remaining visa validity.

- **USCIS EAD rule:** Interim rule of Oct 30, 2025 ended the 540-day automatic extension for most renewals filed on or after that date; final rule effective Oct 14, 2026.

- **HUD Mortgagee Letter 2025-09:** FHA is not available to H-1B, L-1, O-1, TN, OPT or EAD-only borrowers for case numbers on or after May 25, 2025.

- **Freddie Mac PMMS:** 30-year fixed 6.95% (Sept 17, 2026) and 7.40% (Oct 15, 2026), illustration only, not a quote or offer.

## Frequently Asked Questions

**Q: Can I sign a new construction contract if my H-1B expires before completion?**
A: Yes. Lenders evaluate your status at closing, not at contract. The risk is whether you'll have acceptable documents when the loan funds. Plan your extension with your immigration attorney and confirm in writing which documents your lender will accept at closing.

**Q: Will a lender close my loan with only an H-1B extension receipt notice?**
A: Many will, especially if you have a long history with the same employer. Some lenders won't. Fannie Mae leaves documentation to the lender. Ask before you commit, and have a second lender ready.

**Q: How long can I lock a rate on new construction?**
A: Some lenders offer extended locks ranging from a few months to a year or more, usually at extra cost. Others suggest floating until closer to completion. Compare total cost, float-down terms and who pays if the build runs late.

**Q: What happens to my earnest money if my visa renewal is denied during the build?**
A: It depends on your builder contract. Many builder contracts limit financing contingencies, so a denial could put deposits at risk. Have the contract reviewed by a real estate attorney before signing, and talk to your immigration attorney about your renewal.

**Q: Can I use FHA for new construction on an H-1B?**
A: No. As of October 2026, FHA is not available to H-1B, L-1, O-1, TN, OPT or EAD-only borrowers under HUD Mortgagee Letter 2025-09. Conventional loans remain available on the same terms as citizens, subject to lender overlays.
