**Quick answer (updated October 2026):** An H-1B extension pending mortgage is possible. Fannie Mae and Freddie Mac set no minimum visa validity, so a timely filed extension with an I-797C receipt can satisfy the "legally present" requirement. Acceptance is a lender overlay decision, so some lenders close on a receipt and others want the approval first.

Your offer was accepted. Then your loan officer saw your I-797 end date three weeks away. Your employer filed the extension on time and HR says you can keep working. The underwriter is less relaxed.

Extensions run on a three-year cycle and home purchases don't wait for USCIS, so we see this file constantly. This guide covers what the agency rules require, what the 240-day rule does and doesn't prove, how lenders differ, and a step-by-step plan to close with only a receipt notice in hand.

## What an H-1B extension pending mortgage file looks like

When your current I-797 approval is about to expire (or already has), and your employer has filed Form I-129 for an extension, your status documents look like this:

- **Your old I-797A/B approval notice**, with an end date that is near or past.

- **An I-797C receipt notice** showing USCIS received the extension petition, with a receipt date before the old end date.

- **Your I-94 record**, which usually matches the old approval end date.

- **Your passport and visa stamp**, which may also be expired. That is a separate issue, covered in our guide on [an expired visa stamp with a valid I-797](https://www.masalaloans.com/blog/expired-visa-stamp-mortgage).

Nothing in that stack shows a new end date yet. That's the gap.

## What Fannie Mae and Freddie Mac actually require

Fannie Mae's Selling Guide B2-2-02 says non-permanent residents are eligible "under the same terms that are available to U.S. citizens." The lender decides what documentation to collect and warrants that the borrower "is legally present" in the United States. There is no list of approved visas and no required number of months remaining on your status. Freddie Mac's guide takes the same approach.

So the agency question is: can the lender document lawful presence and likely income continuance? A timely filed extension plus an employer letter can answer both. "Valid for 12 more months" is not an agency rule. We break that myth down in [the visa expiration requirement myth](https://www.masalaloans.com/blog/visa-expiration-mortgage-requirement-myth).

FHA is not an option for this file. Since HUD Mortgagee Letter 2025-09 (case numbers on or after May 25, 2025), H-1B holders and other non-permanent residents cannot use FHA financing, as of October 2026. Your path is conventional, jumbo, or a non-QM product.

## The 240-day rule and why lenders care

Federal regulation 8 CFR 274a.12(b)(20) lets certain employer-specific workers, including H-1B holders, keep working for the same employer for up to **240 days** after their authorized stay expires, as long as the extension was filed before that expiration date. If USCIS denies the extension within that window, the authorization ends on the denial.

For a mortgage, that rule shows you remain authorized to work (income continuance) and helps the lender document legal presence while the petition is pending. Two limits matter. The 240-day rule covers work for the **filing employer only**. If your extension is actually a change of employer, you are relying on H-1B portability (AC21), which lets you start with the new employer once the new petition is filed. That is a different fact pattern, and if you're switching jobs mid-process read [changing jobs on an H-1B during your mortgage](https://www.masalaloans.com/blog/change-jobs-h1b-during-mortgage). Second, the clock is not unlimited. If your closing date falls deep into the 240-day window, expect more questions.

## How lenders treat an I-797 receipt: overlays compared

This is where the agency rule and lender reality split. Because Fannie leaves documentation to the lender, each lender writes its own policy. These are the patterns we see when shopping files across our 150+ wholesale lenders (patterns, not any single lender's written policy):

| **Lender approach** | **What they ask for** | **Typical outcome for a pending extension** |
| --- | --- | --- |
| Receipt-friendly | I-797C receipt filed before expiration, employer letter confirming continued employment and sponsorship | Closes on the receipt |
| Receipt plus time cushion | Same as above, but receipt must be recent or closing must fall early in the 240-day window | Often closes, sometimes with extra conditions |
| Approval-required overlay | New I-797 approval notice before clear-to-close | Waits for USCIS or suggests premium processing |
| Remaining-validity overlay | Status valid for a set number of months past closing | Declines until approval arrives |

If your first lender sits in the bottom two rows, that's an overlay, not the law. Our guide to [mortgage lender overlays for visa holders](https://www.masalaloans.com/blog/mortgage-lender-overlays-visa-holders) explains why the same file can be declined at one lender and approved at another.

## Premium processing: when to push for it

If your lender requires the approval, premium processing is the cleanest fix: USCIS charges a fee for a decision window measured in days rather than months, and a pending petition can usually be upgraded.

Ask your employer's immigration team these three questions before you sign a purchase contract:

- Was the extension filed with premium processing, or can it be upgraded?

- Has USCIS issued a Request for Evidence (RFE)? An RFE pauses the clock and should be disclosed to your loan officer.

- Will the company provide a letter on letterhead confirming your role, salary, and that the extension was filed?

An RFE does not automatically kill a mortgage, but it changes the lender's risk view. Tell your loan officer early.

## Step-by-step: closing with only a receipt notice

Here's the sequence we use. Say Arjun, a hypothetical H-1B data engineer in Plano, has an approval ending November 30, a receipt dated October 2, and a December 15 closing.

| **Step** | **When** | **What to do** |
| --- | --- | --- |
| 1 | Before writing offers | Send loan officer old I-797, I-797C receipt, I-94, passport, EAD if any |
| 2 | Before writing offers | Confirm lender accepts receipt notices in writing, not just verbally |
| 3 | At application | Get employer letter: title, salary, start date, extension filed, intent to continue employment |
| 4 | During underwriting | Ask employer about premium processing upgrade as a backup |
| 5 | 10 days before closing | Re-check USCIS case status; disclose any RFE immediately |
| 6 | Final week | Lender completes verbal verification of employment; confirm nothing changed |

Arjun's closing falls about two weeks after his old approval ends, early in the 240-day window, with a clean receipt. That file fits a receipt-friendly lender well. If his closing were six months past the end date with an open RFE, we would match him to a different lender or advise waiting. Along with the status documents, plan on 30 days of paystubs, two years of W-2s, and H-4 documents if your spouse is on the loan.

## What the rules actually say

- **Fannie Mae Selling Guide B2-2-02** (dated 07/28/2015): non-permanent residents are eligible on the same terms as U.S. citizens; the lender determines documentation and warrants legal presence. No visa list or minimum validity period.

- **Freddie Mac Guide 5103.2**: takes the same approach for lawfully residing non-permanent residents.

- **8 CFR 274a.12(b)(20)**: up to 240 days of continued employment with the same employer after a timely filed extension, ending earlier if USCIS denies the petition.

- **HUD Mortgagee Letter 2025-09** (March 26, 2025; case numbers on or after May 25, 2025): non-permanent residents, including H-1B holders, are no longer eligible for FHA, as of October 2026.

## Frequently Asked Questions

**Q: Can I get a mortgage if my H-1B extension is pending?**
A: Yes, often. Agency rules don't require a minimum time left on your status, so a timely filed extension with an I-797C receipt can work. Whether a specific lender accepts it is an overlay question. Some lenders close on the receipt; others require the new approval notice. Shopping multiple lenders usually solves this.

**Q: Does the 240-day rule count as legal presence for a mortgage?**
A: Many lenders treat a timely filed extension under the 240-day rule as adequate documentation of legal presence and work authorization. It is not automatic, because each lender sets its own documentation policy. Bring the receipt notice and an employer letter so the underwriter can tie the two together.

**Q: What if my H-1B extension gets an RFE during my mortgage?**
A: Tell your loan officer right away. Some lenders will then wait for approval. Others can still proceed if the employer confirms continued employment. Your employer's immigration attorney can tell you the RFE's likely timeline; your loan officer can tell you which lenders will tolerate it.

**Q: Should I wait for the H-1B approval before buying a house?**
A: Not necessarily. If your closing falls soon after the old end date and your employer letter is solid, a receipt-friendly lender can usually proceed. Waiting makes sense with an open RFE or a closing date far into the 240-day window.

**Q: Is an I-797 receipt enough for a refinance?**
A: Often yes, using the same logic as a purchase: lawful presence plus continued income. Some lenders are stricter on cash-out than rate-and-term refinances, so get the policy in writing before paying for an appraisal.
